Coup de tonnerre dans le procès en appel de Khalifa Sall. Les avocats de la défense ont décidé de définitivement quitter le procès. Motif invoqué : la partialité supposée de la Cour. Le maire de Dakar est, donc, sans avocat. Nous vous proposons l’intégralité de leur déclaration.
DECLARATION DU COLLECTIF DES AVOCATS DE M. KHALIFA ABABACAR SALL
L’Etat du Sénégal, sous une fausse qualité de partie civile a engagé des poursuites pénales contre M. Khalifa Ababacar SALL, Maire de la Ville de Dakar et Député à l’Assemblée Nationale.
Par arrêt du 29 juin 2018, la Cour de Justice de la CEDEAO a jugé de façon définitive que :
– le droit à un procès équitable de M. Khalifa Ababacar SALL a été violé.
– son droit à la présomption d’innocence a été violé.
– sa détention est arbitraire.
– ses droits de la défense ont été gravement violés.
– l’Etat du Sénégal a été condamné à des dommages et intérêts dont le montant a été fixé à la somme de 35 millions de Francs CFA.
La Cour d’Appel de Dakar n’accepte pas d’appliquer cette décision de justice définitive et d’en tirer les conséquences de droit, notamment de faire cesser la détention arbitraire intolérable et inadmissible dans un état de droit.
La Cour d’Appel de Dakar n’a pas non plus accepté d’annuler la procédure et le jugement et ce en dépit de la présentation des nullités du jugement de condamnation de M. Khalifa Ababacar SALL caractérisant la violation des droits de la défense tel que prévu par le code de procédure pénale sénégalais.
Elle a décidé :
– par le rythme inédit imposé au présent procès.
– par les nombreuses manifestations de partialité qui transparaissent dans ses décisions déjà rendues contre M. Khalifa Ababacar SALL et les débats d’audience.
– par le refus de saisir le Conseil Constitutionnel des exceptions d’inconstitutionnalité présentées par la défense et leurs jugements et rejets sans base légale.
– par la décision de joindre au fond les exceptions dont le caractère préjudiciel sont évidentes.
La Cour d’Appel de Dakar à la suite du Tribunal de Grande Instance Hors Classe de Dakar et du Juge d’Instruction, a achevé de démontrer que le présent procès ne sera plus jamais qu’une justice expéditive pour rendre inéligible notre client M. Khalifa Ababacar SALL à l’élection présidentielle de février 2019.
Dans ces conditions, et pour ne pas se rendre complice d’une défense de connivence avec les atteintes répétées aux droits de leur client, le collectif des Avocats en concertation avec M. Khalifa Ababacar SALL, a pris la décision de quitter le prétoire pour marquer sa désapprobation absolue.
L’opinion publique nationale et internationale sera informée plus en détails sur les circonstances de ce procès purement politique pour lequel la justice sénégalaise refuse l’application de ses lois et règlements et instruments juridiques internationaux.

Yes! Jenna is so effervescent. In a way, it reminds me of the early Sarah Jane days, and you know how I feel about that! I have definitely perked up in my excitement for this upcoming series compared to several before, including some Tennant ones because the ongoing Ten/Rose “will-they/won’t-they” started to wear thin.
