La Cour suprême a rejeté, lundi 26 février, une demande de l’administration Trump de trancher immédiatement sur le programme mis en place par Barack Obama. Ce programme protège d’une expulsion 700 000 “Dreamers” (“rêveurs”) entrés clandestinement aux Etats-Unis.
Le programme, connu sous le nom de DACA (Deferred Action for Childhood Arrival), a été abrogé par Donald Trump, qui avait donné au Congrès jusqu’au 5 mars prochain pour régler définitivement la question des “Dreamers”.
Si le Congrès avait voté cette loi, ceux-ci auraient pu commencer à être expulsés à partir de cette date. Mais un juge fédéral a suspendu la décision.
La décision de la Cour suprême n’était pas complètement inattendue. D’ordinaire, la plus haute instance accepte de se saisir de dossiers qui ont fait l’objet d’appels, ce qui n’est pas le cas ici. Le processus d’appel suivra donc son cours, et il devrait se passer des mois avant que la question ne soit résolue.
L’administration républicaine estime que Barack Obama avait outrepassé ses prérogatives en décidant de créer ce programme sans l’aval du Congrès.
