Aujourd’hui (hier) notre préoccupation est de savoir quelle est la passerelle par laquelle un juge d’instruction a été saisi. Pourquoi on ne nous a pas informés de l’ordonnance ? Quelle est la base légale de tout cela ? », s’est interrogé Me Alassane Cissé. Même son de cloche chez Me Ousseynou Gaye, selon qui on ne peut pas ouvrir les débats sur la base de cette ordonnance. « Comment le parquet a saisi le juge d’instruction ? Sur quel fondement juridique un juge d’instruction peut rectifier sa propre décision ? L’ordonnance qui nous est présentée ne concerne pas ce procès. Ibrahima Mbengue, le juge d’instruction avait-il le droit de modifier l’ordonnance ? », a soutenu Me Gaye. Me Assane Dioma Ndiaye a abondé dans le même sens, et c’est pour dire : « après 30 ans de barre, c’est la première fois que nous voyons une ordonnance de renvoi rectificative ». Me Moussa Sarr a par ailleurs demandé la retenue de l’affaire pour qu’elle soit plaidée. Ainsi, ils pourront savoir sur quelle base légale cette ordonnance rectificative a été faite.
