L’actuel vice-président de Guinée équatoriale, Teodorin Obiang, qui n’est autre que le fils du président guinéen en exercice, a été condamné par contumace, en première instance, à trois ans de prison avec sursis et 30 millions d’euros d’amende avec sursis, ce vendredi 27 octobre 2017 à Paris. Les biens saisis sont confisqués. La justice l’a reconnu coupable dans l’affaire des « biens mal acquis ». C’est inédit.
Blanchiment d’abus de biens sociaux, blanchiment de détournement de fonds publics, blanchiment d’abus de confiance et blanchiment de corruption. La 32e chambre du tribunal correctionnel de Paris estime que Théodora Obiang qui ne s’est pas rendu au procès, s’est rendu coupable de tous ces chefs d’accusation,
La justice française estime que le vice-président équato-guinéen, en exercice s’est frauduleusement bâti en France un patrimoine considérable. La peine prononcée est néanmoins inférieure à celle requise par le parquet national financier, qui demandait trois ans de prison ferme et une amende ferme de 30 millions d’euros.
En revanche, le tribunal a ordonné la confiscation de tous les biens saisis. Notamment un somptueux hôtel particulier avenue Foch, dans la capitale, comme requis par le parquet. Objets d’art, voitures de luxe et de sport… Au total, cela concerne 101 pièces, hammam et discothèque, marbre et robinets recouverts d’or.
La peine de prison et l’amende sont assorties de sursis. Il faut le considérer comme un avertissement directement adressé à la Société générale, à la Banque de France et aux autorités françaises, responsables, selon le tribunal, d’avoir conféré un sentiment d’impunité au vice-président équato-guinéen.
Teodorin Obiang fera certainement appel, ce qui va suspendre cette condamnation et notamment la saisie de ces biens mal acquis qui n’est pas assortie de sursis. Il y en a pour plus d’une centaine de millions d’euros, mais l’essentiel pour les parties civiles, c’est qu’une brèche est désormais ouverte et qu’un nouveau combat s’ouvre : celui de la restitution de ces sommes aux populations.
La présidente du tribunal est également allée dans ce sens. « II faudra que le cadre législatif évolue » a-t-elle dit. Ce sera justement l’objet d’un colloque à l’Assemblée nationale le 23 novembre prochain.
