L’Agent judiciaire et les avocats de l’Etat ont fait du procès Khalifa, le procès de la municipalité de la ville, qui voudrait que le juge note sa constitution de partie civile. Or, aux yeux du procureur de la république, seules les personnes qui se prétendent lésées par l’infraction commise par Khalifa Sall et autres peuvent se constituer devant le tribunal. Il a ainsi demandé au juge Lamotte et à ses assesseurs de rendre alors une ordonnance d’irrecevabilité de la constitution de partie civile du Conseil municipal de Dakar, considérant que rien ne permettait d’affirmer qu’il figurait parmi les victimes de l’affaire de la caisse d’avance. « L’Etat s’est déjà constitué », rappelle le parquet.
