Me Amadou Aly Kane était à la barre ce mardi pour les dernières plaidoiries du procès Khalifa Sall. L’avocat a rappelé un vieil adage musulman : “Les juges sont au nombre de trois : le juge qui connaît le droit et qui dit le droit ; le juge qui connaît le droit et qui ne dit pas le droit ; le juge qui ne connaît pas le droit et qui ne dit pas le droit. Parmi ces trois un seul ira au paradis”, a déclaré, en brin méditatif, Me Kane.
Le conseil a mis en cause le travail du parquet dans l’enquête préliminaire sur l’affaire de la caisse d’avance. Selon l’avocat, c’est une thèse fragile qui a motivé le parquet lorsque celui-ci a accusé d’association de malfaiteurs le maire de Dakar et ses co-prévenus. “Le procureur n’a trouvé aucune preuve pour soutenir ces accusations. Nous demandons donc la relaxe pour les prévenus”, a sollicité l’avocat de la défense, invoquant l’absence de responsabilité pénale du maire de Dakar et Cie dans l’affaire de la caisse d’avance.
Sa demande intervient trois jours après une réquisition de pas moins de 7 ans de prison contre Khalifa Sall et Cie, accusés de détournement de deniers publics. L’avocat s’est attaché à démonter l’image désastreuse donnée de la personnalité des prévenus par la partie civile. Il s’en est pris au procureur de la République et à sa “bande d’enquêteurs”…
