Ce jeudi matin, le Sénégal s’est réveillé assez surpris. Plus que surpris. En effet, suite à la publication de l’information faisant état d’une descente d’éléments de la Gendarmerie dans les locaux de DMedia, les questions ont fusé de partout, surtout qu’il était annoncé qu’ils étaient venus pour fermer la première radio urbaine, la Zik Fm. Effectivement ! Cela aurait été le cas si des clarifications n’étaient pas apportées.
En effet, l’huissier nommé M. Guèye, accompagné de son clerc Barry, étaient venus dans les locaux du groupe pour une saisie de matériels. Il faut rappeler qu’une décision de justice était sortie, condamnant La Tribune pour diffamation concernant un imam qui était cité dans une histoire de mœurs.
Le journal avait été condamné à juste titre par la justice et les deux journalistes concernés n’avaient pas assisté au procès. Donc, ils ont été jugés et condamnés par défaut. Voilà la vérité des faits. Maintenant, il faut savoir que cette décision de justice concernait strictement la structure DMedia Sarl qui concerne uniquement les supports écrits à savoir : actunet, tribune et Nouvel Hebdo. Sen Tv SA et Zik Fm SARL étant d’autres entités avec un statut juridique clair.
Alors, l’huissier qui n’a rien compris a systématiquement voulu pénétrer dans les locaux de Zik Fm d’abord, puis Sen Tv. Voulant faire exécuter (sa) décision, il a fallu que les responsables du groupe saisissent l’avocat du plaignant à savoir Me Abdou Dialy Kane pour le faire revenir à la raison. Mais, c’est comme s’il y avait cette ferme envie de fermer la radio. D’ailleurs, Bougane Guèye, Pdg dudit groupe de presse s’est voulu clair en expliquant ceci : «L’affaire est simple : La Tribune a diffamé un imam du nom de Babacar Sow en le traitant d’homosexuel. Le journal a tort, il faut que justice soit faite. Donc qu’on saisisse les biens de La Tribune ne pose pas problème. Seulement, l’huissier s’est trompé en allant dans les locaux de la Zik Fm. La Tribune est une entité qui appartient à D-Média Sarl alors que Zik Fm est une entité juridique indépendante.» L’affaire remonte à 2013 et le juge avait avait tranché en faveur dudit imam en lui octroyant 10 millions. Voici la vérité des faits.
