Extirpée du champ du Code des marchés publics par la loi n°2017-32 fixant ses règles d’organisation et de fonctionnement, la Caisse de dépôts et consignation pilotée par Aliou Sall n’est pas soumise au contrôle de l’Autorité de régulation des marchés publics.
Interpelé à ce propos hier, en marge de la publication du rapport 2016 de l’Armp, Saer Niang s’est montré circonspect sur la question, même s’il indique ne pas apprécier que la Cdc et certaines structures soient hors de contrôle en ce qui concerne les passations de marché. Précisant que la Cdc fait partie des bons élèves du rapport 2016 de l’Armp, il assure être dans les dispositions de respecter la nouvelle législation mais émet certaines réserves.
«C’est vrai qu’il y a une loi qui considère qu’en raison de la spécificité des activités de la Cdc les marchés peuvent être conclus à travers le manuel de procédure. C’est une loi, une loi est faite pour être appliquée. Ce n’est pas à moi de vous dire si une loi est mauvaise ou si elle est bonne. Je signale que ce n’est pas la seule structure soumise à cette disposition. Il y en a d’autres telles que le Fonsis. Ils sont dans le secteur financier et dans le secteur bancaire quelque part. Il y a une spécificité.
On est en train de discuter et de voir exactement la pertinence de cette mesure» assure le directeur général de l’Armp qui, compare la Cdc au Fonsis, à la Bhs, à l’Ipres et à la Caisse de sécurité sociale. Il n’exclut pas de demander l’arbitrage d’une structure tierce, en l’occurrence la Cour Suprême, pour savoir si la Cdc a légalement la latitude d’être soustraite au contrôle de l’Armp.
«Des structures comme la Bhs, l’Ipres la Caisse de sécurité sociale sont des structures assez particulières où il y a une réflexion à mener pour savoir est ce qu’il faut les contraindre dans le code des marchés publics ou est ce qu’il faut leur donner la latitude d’être dans le secteur de l’investissement, du financement et de pouvoir prospérer sans l’Armp. C’est un débat qui est ouvert, c’est une loi qui est votée. On a échangé. Ce n’était pas notre interprétation de la loi.
On estime à l’Armp que la loi a dit : «il faut avoir un manuel de procédures mais le manuel de procédure n’exclut pas l’application du code des marchés publics». On est en train de discuter, c’est notre point de vue, on l’a déjà fait savoir à la caisse de dépôts et consignations qui n’est pas fermée sur la question» indique Saer Niang..
