Avocats de l’Etat auprès de la Crei – Une constitution qui pose problème

Au moment où les avocats commis par l’Etat dans le cadre de la traque des biens mal acquis courent derrière leurs honoraires, leur constitution pose même problème. La preuve, ces avocats qui avaient fait le déplacement à Paris pour plaider une procédure contre Karim Wade portant sur des immeubles qui lui appartiendraient dans ce pays, ont été déboutés  devant le Tribunal de Grand instance de Paris où le  président de séance leur a fait comprendre qu’ils ne sont pas habilités à se constituer dans cette matière pour le compte de l’Etat du Sénégal. Le juge français avait répondu aux avocats du Sénégal que c’est le parquet de Paris qui représente l’Etat du Sénégal qui n’a pas à constituer d’avocats. 
Avec le mimétisme juridique qui fait que le droit sénégalais soit repris du droit français, dans la traque des biens, c’est au procureur de la Crei et à lui seul de représenter l’Etat  qui n’a pas besoin de recourir à des avocats pour défendre sa cause. De ce qui précède, on comprend pourquoi, l’Etat du Sénégal joue au caméléon pour honorer ses engagements envers ses avocats qui lui réclament des sous, et avec lesquels, il a compris bien après le service effectué qu’il pouvait bien se passer d’eux.
