Le Conseil national de régulation de l’audiovisuel (CNRA) s’est fendu, hier, d’une déclaration pour rappeler une de ses missions. A savoir le contrôle du contenu des messages publicitaires diffusés par les supports audiovisuels. «Le contenu de ces messages doit respecter l’interdiction de tout procédé constitutif d’une publicité ou d’une promotion directe ou indirecte du tabac, de ses produits et dérivés à la radio», rappelle le CNRA. Une mise au point qui fait suite au «message publicitaire diffusé par certains médias audiovisuels en faveur de la Manufacture des Tabacs de l’Ouest Africain (MTOA)».
Le CNRA relève que cette pub «n’est pas conforme à ce dispositif prévu par la loi n° 2014-14 du 28 mars 2014 relative à la fabrication, au conditionnement, à l’étiquetage, à la vente et à l’usage du tabac, encore moins aux articles 19 et 21, du cahier des charges applicable aux radios privées commerciales». Selon l’article 9 de la loi de 2014, souligne l’instance que dirige Bab’s Touré, «sont interdites la publicité et la promotion directe ou indirecte en faveur du tabac, de ses produits et dérivés et des sociétés qui les fabriquent, les commercialisent ou les distribuent : au cours d’émissions de radiodiffusion ou de télévision, d’enregistrements effectués par la presse écrite et sur des supports utilisant les technologies de l’information et de la communication».
Le communiqué note que l’article 19 du cahier des charges applicable aux radios privées commerciales stipule que «les messages publicitaires doivent être conçus dans le respect des intérêts des consommateurs. Ils ne doivent en aucun cas directement ou indirectement, par omission ou en raison de leur caractère ambigu, les induire en erreur». Enfin, dit le CNRA, selon l’article 21 dudit cahier des charges : «sont interdits les messages publicitaires concernant les produits faisant l’objet d’une interdiction législative ou règlementaire». «La violation de ces textes explique les observations envoyées par le CNRA aux différentes radios concernées, pour l’arrêt immédiat de la diffusion du spot, avec ampliation au Directeur Général de la MTOA pour information», dit le texte.
«Le Conseil national de Régulation de l’Audiovisuel, rappelant que l’entité titulaire d’une autorisation de diffusion de programmes radio est responsable du contenu des émissions qu’elle diffuse, appelle les éditeurs audiovisuels à prendre les mesures appropriées pour ne pas diffuser des messages publicitaires concernant les produits dont la publicité ou la promotion fait l’objet d’une interdiction législative ou règlementaire ou à mettre un terme définitif à de pareils manquements», conclut le communiqué de l’instance de régulation des médias.
