La chambre criminelle du tribunal de Grande instance de Matam (nord) a acquitté lundi six personnes, poursuivies pour des infractions de malfaiteurs, infanticide, complicité d’infanticide et infraction aux lois sur les inhumations. Il s’agit de Fatimata Samba Diong, Coumba Diong, Abou Diong, Abdourahmane Diong, Badiallo Diong et Ibrahima Koumé.
Les faits remontent en 2014 lorsque Fatimata Samba Diong a accouché d’un bébé de sexe masculin suite à une grossesse non désirée contractée en l’absence depuis 7 ans de son mari qui vit au Gabon. Les prévenus avaient fait ingurgiter au bébé un liquide toxique procuré par Badiallo Diong. Le bébé décédé est enterré avec l’aide d’Abou Diong, Abderrahmane Diong et Ibrahima Koumé sans autorisation d’inhumation.
Le procureur, Abdoulaye Bâ, après son réquisitoire avait demandé une peine de 5 ans de prison ferme pour les accusés poursuivis pour « des faits d’une gravité extrême et qui constituent une catastrophe humaine et un fléau qui gangrène la société ». Il a estimé que les accusés méritent « une sanction exemplaire ».
Les avocats de la défense, Adama Fall, Mamadou Ciré Bâ etc., avaient plaidé l’acquittement « pur et simple » de leurs clients faute de preuves. Le tribunal les a finalement relaxés faute de preuves.
Abou Diong, Abdourahmane Diong, Ibrahima Koumé qui ont écopé de 6 mois de prison ferme pour infraction aux lois sur les inhumations retrouvent la liberté après avoir déjà passé 4 ans en prison. Les autres avaient bénéficié de liberté provisoire.
