En effet, dans un communiqué, le Forum du Justiciable exhorte le procureur de la République à s’autosaisir et à enclencher une procédure contre le chroniqueur de la Tfm.
«Suite à la publication d’une vidéo sur les réseaux sociaux où le syndicaliste M. Birima Ndiaye par ailleurs chroniqueur à la TFM, profère des insultes publiques et des menaces de mort à l’endroit des étudiants de l’Université Gaston Berger de Saint Louis : «nous sommes armés et prêts à tuer un étudiant….», le Forum du Justiciable demande solennellement au procureur de la République de s’autosaisir pour des faits d’injure publique et menace de mort, délits poursuivis et punis par le code pénal sénégalais et qu’importe le contexte et la date où la déclaration a été tenue», relève le document.
Avant de mettre en garde contre de tels faits qui doivent être punis : « Cette déclaration de M. Birima Ndiaye est d’une gravité extrême. Elle incite à la haine et peut plonger le pays dans une instabilité totale. Le Forum du Justiciable estime que si nous voulons préserver la paix sociale, une telle de déclaration ne doit pas rester impunei et surtout, dans un Etat de droit ».
