«Aujourd’hui, si un citoyen est accusé, il faut lui garantir les conditions optimales d’un procès équitable, un procès qui réponde aux normes d’un bon procès. C’est pour cela que l’autorisation de juger le maire Khalifa Sall dans le cadre d’un procès équitable, est demandée à l’Assemblée nationale parce que la Constitution est claire en son article 61», a-t-il déclaré en marge de la passation de service avec l’ex-ministre des Affaires étrangères, Mankeur Ndiaye qui devra désormais piloter le Comité national de l’Initiative pour la transparence dans les industries extractives (Itie).
Dans son propos, le ministre qui ne veut pas tenir des propos pouvant influencer le cours de la justice, se veut clair. «Khalifa Sall a été élu député ; a-t-il une immunité parlementaire ou non, c’est un débat qui peut être mené. En tous cas, il a été arrêté bien avant. Mais, le plus important, ce n’est pas d’épiloguer sur l’immunité parlementaire. Le plus important, c’est de respecter toutes les formes qui garantissent la tenue d’un procès équitable. Il ne faut oublier aucun détail procédural susceptible de remettre en cause ses droits», a relevé le natif de Rufisque.
«C’est dans ce sens simplement, que, même si la levée de l’immunité parlementaire n’était pas en l’occurrence obligatoire, l’option a été faite de demander à l’Assemblée nationale l’autorisation de le juger parce qu’il s’agit d’un député. C’est à l’Assemblée nationale de donner ou de ne pas donner l’autorisation», précise-t-il sur Radio Sénégal internationale (Rsi).
Auparavant, le ministre a indiqué que «c’est parce qu’il est respectueux de l’indépendance de la justice, il ne va pas tenir des propos qui semblent aller dans le sens d’influencer le cours de la justice».
