Le problème de l’indépendance de la Justice est “étroitement lié à la manière dont sont désignés ou affectés les magistrats”, indique l’ex-Substitut général de la Cour d’appel de Dakar qui a démissionné de la Magistrature.
À ce propos, parlant des réformes “qu’on doit faire pour que la désignation de magistrats se fasse dans la plus grande transparence”, l’ex-magistrat prône l’ouverture du Conseil supérieur de la magistrature (Csm) à des membres du “corps social”.
“Le (Csm) est composé juste de l’Exécutif et des magistrats. L’innovation, c’est de mettre l’accent sur les membres du corps social, la société civile, le parlement (un député de l’opposition, un député de la mouvance présidentielle), le représentant du syndicat le plus représentatif, suggère Ibrahima Dème. Des membres du corps social avec les Magistrats et l’Exécutif.”
Le magistrat d’ajouter : “Quand on est dans cette logique d’ouverture, on n’exclut personne. L’Exécutif peut avoir sa place au sein du Csm tout en prenant des dispositions pour que l’exécutif ne puisse pas influer sur les décisions.”
Le juge Ibrahima Hamidou Dème était l’invité de l’émission “Objection” sur Sud fm de ce dimanche 13 mai 2018.
