Se prononçant sur la possibilité que sollicite la ville de Dakar aux fins de se constituer partie civile dans cette affaire, la robe noire a plaidé que «l’action est recevable pour tous les chefs de dommage matériels et moraux».
En d’autres termes, l’institution municipale, selon ses dires, peut bel et bien désigner son conseiller juridique Me Moussa Sow pour la représenter au procès. Le fait que le préfet ait demandé la relecture du rapport de présentation de la ville de Dakar a outré Me Diouf. Il en déduit qu’il s’agit d’une «manipulation et d’un complot d’Etat».
«Les deniers ne sont publics, ce sont les deniers de la ville Dakar. Il appartient à la ville et non au tribunal de définir l’existence de préjudices subis. Le mis en cause ne peut pas représenter la ville de Dakar dans cette affaire. C’est Khalifa en tant que maire qui est poursuivi et non l’institution», croit savoir l’avocat. Ce dernier pense qu’il incombe au préfet de saisir la Cour suprême pour constater le non-respect supposé de la relecture du rapport mentionné plus haut.
Son confrère de la partie adverse, Me Babou, détecte anguille sous roche à travers cette volonté de la ville de Dakar de se constituer et parle de «polyvalence». En clair, soupçonne Babou, «Il y a un formalisme à respecter pour être partie civile». «Vous pouvez l’écarter, mais vous ne pouvez pas l’annuler», avertit l’avocat à l’endroit de Me El hadj Diouf et Cie.
