Le Conseil constitutionnel rappelle aux parlementaires les principes intangibles de la séparation des pouvoirs. Il a décidé, vendredi 8 septembre, de censurer la suppression de la réserve ministérielle, une des mesures symboliques que les députés avaient introduites en juillet lors du débat sur les deux projets de loi, organique et ordinaire, de « moralisation », rebaptisées lois « pour la confiance dans la vie politique ».
Ce devait être le pendant de la suppression de la réserve parlementaire à laquelle rechignaient les sénateurs et les députés de l’opposition. Promesse électorale d’Emmanuel Macron après le ralliement de François Bayrou à sa candidature en février, la disparition du mécanisme permettant aux parlementaires de distribuer des subventions à des associations et à des communes pour certains investissements, était une mesure phare du projet de loi. Symbole du clientélisme pour les uns, outil indispensable de soutien aux projets dans les territoires pour les autres, la réserve parlementaire a représenté 146 millions d’euros en 2016.
