Le numéro de « Jeune Afrique » à paraître cette semaine, a fait un focus sur le rapport confidentiel de la Banque mondiale concernant l’affaire Karim Wade dont le journal sénégalais Walfquotidien a révélé la teneur. Au cœur de ce rebondissement, un ancien magistrat français, Jean-Louis Hérail, fondateur du cabinet Hersen partners et conseiller technique à la BM, dans le cadre du programme Star (Stolen asset recovery initiative).
En 2012, après que le Sénégal a sollicité l’appui de Star, ce consultant est chargé de mener une enquête parallèle sur l’affaire Wade. Il dispose alors d’un bureau dans l’enceinte de la Cour de répression de l’enrichissement illicite (Crei), à Dakar. Et, au fil des mois, la justice sénégalaise lui transmet l’intégralité du dossier d’instruction, en théorie confidentiel. Fin 2013, après avoir épluché les documents et relevés bancaires relatifs aux sociétés d’Ibrahim Aboukhalil (alias Bibo Bourgi) et de son frère Karim Aboukhalil, tous deux soupçonnés d’avoir été les prête-noms de Karim Wade, Herail rend à la Crei un rapport de plus de 300 pages.
Ses conclusions vont à rebours de la thèse des magistrats sénégalais. Selon lui, les sociétés de la galaxie Bourgi n’ont aucun lien financier visible avec Karim Wade. L’ex-magistrat français plaide alors en faveur d’un non-lieu ou d’une liberté provisoire au bénéfice des inculpés, dans l’attente du procès. Les autorités sénégalaises s’abstiennent de verser son rapport à la procédure.
En mars 2015, Karim Wade sera condamné à six ans de prison. Alors que ce document ressurgit, la prudence est de mise dans le camp présidentiel. «Je doute que le Sénégal ait commandité ce rapport », confie Aminata Touré, l’ex-ministre de la Justice. La défense de Karim Wade relève toutefois qu’aucun démenti officiel n’a été formulé. Les avocats du candidat déclaré du Parti démocratique sénégalais (Pds, opposition) à la présidentielle de 2019, entendent verser prochainement le rapport Herail à la procédure ouverte à Paris pour détention arbitraire contre leur client. Contacté par JA, Jean-Louis Herail n’a, lui, pas souhaité s’exprimer.
