Par l’intermédiaire de ses avocats, Khalifa Sall a adressé ce jeudi une correspondance (voir ci-dessous) au président de l’Assemblée nationale, Moustapha Niasse. Le maire de Dakar a signalé à Niasse avoir appris, d’articles de la presse de ce jour, que Monsieur le Procureur de la République a initié une demande de levée de (son) immunité parlementaire et que, en tant que président du Parlement, il en est déjà saisi.
Invoquant l’article 52 du Règlement intérieur de l’Assemblée nationale, qui permet au député concerné par une procédure de levée d’immunité parlementaire de se faire défendre par un de ses collègues devant la commission qui l’auditionne, Khalifa Sall prévient qu’il “n’acceptera pas d’être entendu par la Commission tout en étant en état de détention, ce qui serait d’ailleurs paradoxal”.
Pour Khalifa Sall, “cette demande constitue l’aveu manifeste que depuis son élection en qualité de député du Sénégal à l’occasion de l’élection législative du 30 juillet 2017 dont les résultats ont été proclamés par le Conseil constitutionnel par décision en date du 14 août 2017, (il) ne pouvait plus faire l’objet de poursuites ni de détention sauf autorisation de l’Assemblée nationale”.
