Et à cause de cela, il est nécessaire pour une bonne administration de la justice, une réelle indépendance de la magistrature et une véritable séparation des pouvoirs, que le parquet soit indépendant du pouvoir exécutif, à l’instar des magistrats du siège. Cependant, il serait nécessaire de mettre en œuvre des mécanismes constitutionnels afin que leur pouvoir soit contrôlé et freiné afin d’éviter des dérapages. Aujourd’hui le parquet est régulièrement manipulé par le pouvoir politique, ce qui annihile toute possibilité d’indépendance de la magistrature aux yeux de l’opinion. Même si l’article 7 du statut de la magistrature précise « qu’à l’audience la parole est libre » consacrant le vieil adage « la parole est libre, la plume serve », à défaut de mesures de protection efficaces, les magistrats du parquet peuvent constituer des « marionnettes » au service exclusif du pouvoir exécutif. Les dispositions actuelles du statut contribuent à cette situation. En effet, l’article 7 précité stipule que « les magistrats du parquet sont placés sous la direction et le contrôle de leurs chefs hiérarchiques et sous l’autorité du Garde des Sceaux, Ministre de la Justice… Ils peuvent être affectés sans avancement par l’autorité de nomination d’une juridiction à une autre s’ils en font la demande ou d’office, dans l’intérêt du service, après avis du Conseil supérieur de la Magistrature ».
