Les procédures de saisies et de recouvrement de créances sont bloquées à Kolda, Sédhiou et Ziguinchor, à cause de l’absence de commissaires-priseurs dans ces trois localités. D’où la colère noire des autorités judiciaires et des justiciables.
Procéder à la vente aux enchères ou à une saisie est devenu un véritable casse-tête pour les autorités judiciaires et les justiciables des régions de Kolda, de Sédhiou et de Ziguinchor. Et pour cause, ces trois régions du sud du pays ne disposent pas de commissaires-priseurs. Les autorités judiciaires et les justiciables sont dans le désarroi total. « A Kolda et Sédhiou, il n’y a pas de commissaires-priseurs. Tandis qu’à Ziguinchor, il y a un commissaire-priseur, mais qui est très âgé. Il a plus de 80 ans. Il est même un mal voyant. Donc, il n’opère plus, si bien que ni à Ziguinchor, ni à Sédhiou et ni à Kolda, il n’y a d’exécution de décisions de justice. Ça veut dire que la justice n’est pas rendue jusqu’au bout », regrette Me Prosper Djiba, avocat à la Cour installé à Kolda.
« Les décisions de justice qui sont là, si elles ne sont pas traduites dans la réalité par un commissaire-priseur, elles ne serviront à rien, ajoute l’avocat’’. En effet, explique la robe noire, ‘’le commissaire-priseur est un officier ministériel qui a pour attribution de procéder à la vente aux enchères publiques à l’amiable ou judiciaire. Il peut être commis par les tribunaux ou requis par des particuliers. Il est mandaté pour organiser et diriger les ventes publiques. Le commissaire-priseur est l’arbitre du marché chargé de défendre les intérêts du vendeur par la garantie de paiement et de protéger l’intérêt de l’acheteur par la garantie de l’authenticité ».
